This website is operated by GLEAMIFY LIMITED under the brand Gleamify. GleamifyArt is the name of our online storefront. Throughout the site, “we”, “us” and “our” refer to GLEAMIFY LIMITED.

By visiting our site or purchasing from us, you use our “Service” and agree to these Terms of Service (“Terms”), together with the policies linked on this website. These Terms apply to all users of the site.

SECTION 1 - ONLINE STORE TERMS

You must be at least the age of majority in your place of residence, or have permission from a parent or legal guardian, to use this Service. You may not use our products or Service for unlawful or unauthorized purposes.

SECTION 2 - GENERAL CONDITIONS

We may refuse service, cancel an order, limit quantities, or restrict access where reasonably necessary, including for suspected fraud, payment risk, abusive conduct, unlawful content, intellectual-property concerns, or violations of these Terms. Your non-payment information may be transferred through networks and adapted to technical requirements. Payment-card information is encrypted during transmission by our payment providers.

SECTION 3 - INFORMATION ON THIS SITE

We aim to keep product, pricing, availability, timing, and other information accurate, but errors may occur. We may correct errors or update information without prior notice. Images and colors may vary between screens and finished custom products.

SECTION 4 - PRODUCTS, PRICING, AND ORDERS

Prices and product availability may change without notice. We may modify or discontinue products or services. We may reject or cancel orders that appear fraudulent, abusive, commercially resold without authorization, technically erroneous, or impossible to fulfil. If we cancel a paid order, we will issue an appropriate refund.

Promotions, discount codes, free-shipping offers, and gifts are subject to their stated conditions and may not be combined unless we expressly allow it.

SECTION 5 - CUSTOM AND PERSONALIZED PRODUCTS

Custom products are created from the photos, text, names, style choices, and other details you provide. You are responsible for checking that all submitted information is accurate and suitable.

We normally provide a preview within 24-48 hours. Production starts only after you approve the preview and normally takes 1-2 business days. Once approved production begins, personalized orders cannot be canceled or returned for change of mind. Our Refund & Revision Policy applies to revisions, defects, damage, incorrect items, and approved returns.

SECTION 6 - CUSTOMER CONTENT AND PERMISSIONS

By submitting photos, names, text, instructions, or other content, you confirm that you own the content or have all permissions necessary for us to use it to design, produce, fulfil, support, and improve your order. You confirm that the content does not violate intellectual-property, privacy, publicity, or other rights and is not unlawful, abusive, discriminatory, or offensive.

You grant us a limited, non-exclusive license to process submitted content only as reasonably necessary to provide and support the Service, comply with law, prevent fraud, and resolve disputes. We may use automated tools, including AI-assisted tools, as part of the creative workflow, with human review of custom artwork.

SECTION 7 - BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase, billing, contact, and delivery information. You are responsible for activity under your account and for keeping login details secure. Taxes, duties, or import charges may apply where required by law or destination rules.

SECTION 8 - THIRD-PARTY SERVICES AND LINKS

Our store is hosted by Shopify and may use third-party payment, shipping, analytics, support, personalization, and marketing services. Third-party links or tools may be provided for convenience and are subject to the relevant third party's terms. We are not responsible for third-party websites or services outside our reasonable control.

SECTION 9 - PRIVACY

Our collection and use of personal information are described in our Privacy Policy. By using the Service, you acknowledge those practices and the involvement of service providers needed to operate our store and fulfil orders.

SECTION 10 - PROHIBITED USES

You may not use the site or Service to violate law; infringe rights; submit false, malicious, discriminatory, obscene, or abusive content; transmit malware; scrape or interfere with the Service; evade security controls; collect personal information unlawfully; or engage in fraud or deceptive conduct.

SECTION 11 - DISCLAIMER OF WARRANTIES

Except where applicable law requires otherwise, the Service and products are provided on an “as available” basis. We do not guarantee uninterrupted or error-free website operation. Reasonable variations in color, crop, texture, layout, and appearance caused by screens, source-photo quality, materials, or custom production are not defects.

SECTION 12 - LIMITATION OF LIABILITY AND INDEMNITY

To the maximum extent permitted by law, GLEAMIFY LIMITED and its personnel, service providers, and affiliates are not liable for indirect, incidental, special, punitive, or consequential loss, including loss of profit, revenue, data, or opportunity, arising from the Service or products. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

You agree to indemnify GLEAMIFY LIMITED against third-party claims arising from content you submit, your unlawful use of the Service, or your violation of these Terms or another party's rights, to the extent permitted by law.

SECTION 13 - GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Subject to any mandatory consumer protections that apply where you live, the courts of the Hong Kong Special Administrative Region have jurisdiction over disputes arising from these Terms or the Service.

SECTION 14 - SEVERABILITY, TERMINATION, AND CHANGES

If any provision is found unenforceable, the remaining provisions remain effective. We may suspend or terminate access for a material violation of these Terms. Obligations and liabilities incurred before termination survive where appropriate.

These Terms and the policies posted on the site form the entire agreement relating to the Service. We may update these Terms by posting a revised version. Continued use after an update constitutes acceptance to the extent permitted by law.
